What should you do as an employer if you don’t want to pass a workplace vaccine mandate?

Speaking at a webinar with 4S on June 24, Jules Arntz-Gray, Director, Occupational Health & Safety Branch, Ministry of Labour, Training & Skills Development, said – “It is worth encouraging your staff to get vaccinated. It is one of the best controls obviously for COVID-19. But, if you have someone who isn’t getting vaccinated or you are not going to mandate vaccine. That’s okay. Just use other controls. Ask yourself what’s your safety plan, what controls you have in place. So, if we see that there’s no vaccination, we might say what are you doing to keep your people 2 meters apart, are you using PPE? Those are the kinds of questions we would be asking during our inspection visits“.

The main goal of Ontario’s COVID-19 vaccination plan is to ensure that everyone in Ontario should be able to get the vaccination, if they want one. However, the OHS Act does not mention anything that addresses the enforcement of employer vaccination policies for workers. That said, there may be other statutes and considerations that may apply to a workplace vaccination policy.

Any employer policy on vaccination of staff must consider the Ontario Human Rights Code including, for example, medical conditions that prevent vaccination.

Workplace vaccine – any effective public health measure

Vaccination is an effective public health measure for the control of vaccine preventable diseases. Moreover, the Ministry of Health is responsible for public health programs. This includes the roll out of immunization programs intended to address COVID-19 infections.
